1. Service Description

OshiCart ("the Service") provides an online platform for merchants to create product catalogs, receive orders, and manage payments via WhatsApp-linked storefronts. The Service is operated from Namibia.

2. Merchant Responsibilities

Merchants are responsible for the accuracy of their product and service listings, pricing, and fulfillment of orders. OshiCart does not handle payment processing directly — merchants receive payments through their chosen payment methods, which may include bank transfer (EFT), Cash on Delivery, MTC Maris, FNB Pay2Cell, and eWallet services.

3. Payment Disclaimer

OshiCart facilitates the display of merchant payment details (including bank account information, mobile money numbers, FNB Pay2Cell numbers, and eWallet details) and enables proof-of-payment uploads. We generate unique payment references for each order to help merchants match payments. We do not process, hold, or transfer funds. All financial transactions occur directly between the customer and merchant. OshiCart is not liable for payment disputes.

4. Data Usage

We collect merchant account information (email, WhatsApp number, store details, bank/payment details) and customer order information (name, phone number, order details). We also collect aggregated analytics data such as page views and order statistics. Data is stored securely and not shared with third parties. See our Privacy Policy for details.

5. Service Tiers

OshiCart offers the following subscription tiers:

  • Oshi-Start (Free Trial): 20 products and 20 orders per month, for 30 days (35 days if you were referred by an OshiCart agent). This is the full Oshi-Storefront feature set at smaller limits, with a "Powered by OshiCart" badge shown on your storefront and checkout.
  • Oshi-Storefront (N$149/month): Up to 50 products and 50 orders per month, with priority placement in Browse Stores. Includes automated WhatsApp order updates, products, services and appointment bookings, your customer list and order history, verified-purchase reviews, WhatsApp broadcast messaging to your own customers, bulk CSV product import, inventory tracking, coupon codes, recording payments received, courier booking, sales analytics, and removal of OshiCart branding.
  • Oshi-Automate (N$399/month): Up to 200 products and 300 orders per month. Includes everything in Oshi-Storefront, plus abandoned-checkout WhatsApp recovery, monthly statements with VAT totals, bank reconciliation showing payments received against amounts outstanding, and spreadsheet export.
  • Oshi-Pro (N$799/month): Unlimited products and unlimited orders per month, with everything included in Oshi-Automate.

OshiCart reserves the right to modify pricing with 30 days notice.

6. Platform Role & Liability

OshiCart is a platform, not a seller. We provide tools for merchants to list products and receive orders. OshiCart does not sell, ship, or guarantee any products listed on the platform. All transactions are between the customer and the merchant. OshiCart is not liable for product quality, delivery, or disputes between customers and merchants.

7. Customer Reviews

A customer who has completed an order may leave a public review and star rating for the merchant they ordered from. Reviews can only be submitted using the unique link sent for that specific order, so they cannot be created by the merchant themselves, by a competitor, or by anyone who has not actually placed and completed an order with that store. Merchants may reply publicly to a review but may not edit or delete it. OshiCart may remove a review that violates these Terms — for example, content that is abusive, defamatory, or discloses another person's private information — at its discretion.

8. Marketing Messages & Customer Communication

On plans that include WhatsApp Broadcast, merchants may send promotional messages to their own past customers. These messages are sent directly from the merchant's own WhatsApp number and account — OshiCart does not send, and does not store the content of, these messages. Merchants are solely responsible for the content of their marketing messages and for complying with applicable Namibian law regarding unsolicited communications. A customer may ask a merchant not to receive further marketing messages, and merchants must honour such requests. OshiCart keeps a record of which customers a merchant has contacted through Broadcast and when, to help merchants avoid contacting the same customer too often — this record does not include the message content.

9. Prohibited Items & Conduct

Merchants may not list the following on OshiCart:

  • Counterfeit, stolen, or illegally obtained goods
  • Weapons, ammunition, or explosives
  • Controlled substances or illegal drugs
  • Adult content or services
  • Items that violate Namibian law
  • Products with misleading descriptions or fake images

Merchants must not engage in:

  • Accepting payment without intent to deliver
  • Using fake proof of payment to defraud other merchants
  • Creating multiple accounts to circumvent limits
  • Impersonating other businesses or individuals

10. Consequences of Violation

OshiCart reserves the right to suspend or permanently ban any merchant account found violating these terms. Actions may include:

  • Immediate store suspension pending investigation
  • Permanent ban for confirmed fraud or prohibited items
  • Reporting to relevant Namibian authorities where applicable

Customers can report stores via the "Report Store" button on any storefront. All reports are reviewed by the OshiCart team.

11. New Stores

New stores are active immediately upon signup with no order limits. OshiCart reserves the right to monitor new stores and take action if fraudulent activity is detected.

12. Termination

Either party may terminate at any time. Upon termination, merchant data will be retained for 30 days before deletion.

13. Limitation of Liability

OshiCart is provided "as is". We are not liable for lost orders, payment issues, or service interruptions beyond reasonable effort to maintain uptime.
